A Lecturer from the Physics Department Publishes a Scientific Research Paper on the Convergences between the Iraqi and French Civil Codes, Amended in 2016

Lecturer Dr. Jihan Haider Khalil published a scientific research paper entitled “Convergences between the Iraqi and French Civil Codes, amended in 2016” in the Journal of the College of Law and Political Science at the University of Iraq, Baghdad.
The research aimed to identify the legal rules found within the Iraqi Civil Code, which are of French origin. The Iraqi legislator has drawn inspiration from these rules and texts since the drafting of the Iraqi Civil Code, which is a mixture of Islamic jurisprudence rules and French texts, whether directly inspired by the Iraqi Civil Code or from the Egyptian Civil Code, which derived these rules from the French Civil Code. The latter law is the inspiration for the Iraqi legislator, as is the case.
The research also included sources of convergence between the Iraqi and French Civil Codes, amended in 2016, with the Iraqi legislator taking the lead, taking into account the differences in wording, the strength of the text, and its effectiveness between the positions of the legislators. The Iraqi legislator’s position on the promise to contract, as set out in Article (91) of the Iraqi Civil Code, was characterized by generality and comprehensiveness. The study concluded that the Iraqi legislator regulated the issue of the promise to contract in a precise manner, particularly with regard to the promisor’s breach of his promise, and did not leave this to interpretations that extend to it, similar to the French Civil Code.
